1031 Exchange limitations

It is used by investors to buy and sell similar investments while postponing taxes on the profits generated along the way. Do it right, and there is no tax. Internal Revenue Code, which allows you to avoid paying capital gains taxes when you sell an investment property and reinvest the proceeds from the sale within certain time limits in a property or properties of like kind and equal or greater value.


The limitation is only on the total (aggregate) identified value. That’s a sigh of relief. This code allows exchanges of one property for another to proceed without the immediate recognition of capital gains or losses due upon sale. To put it simply, this strategy allows an investor to “defer” paying capital gains taxes on an investment property when it is sol as long another “like-kind property” is purchased with the profit gained by the sale of the first property. Exchange transactions are always started with the intention of acquiring one or more like-kind replacement properties so that the investor can defer the payment of his or her depreciation recapture taxes and capital gain taxes.


It states that none of the realized gain or loss will be recognized at the time of the exchange. This means that investors and developers who strictly “flip” properties do not qualify for exchange treatment because their intent is resale rather than holding for an investment. This 45-day window is known as the identification period. In effect, you can change the form of your investment.


In your case, if your apartment building is owned by a legal partnership or an LLC, you, Fred and Sue must decide as a group if you’re going.
